The Content Removal Policy is part of the User Agreement and although it is in a separate document this policy is part of the Terms. This policy allows us to remove content from the Platform and references the applicable parts of the User Terms.
Subs has duties to protect its Users and this policy together with the applicable User Terms sets out the measures that Subs considers necessary. Any content that is contrary to the Acceptable Use Policy, clause 7.1 of the terms, illegal by virtue of the law of obscenity or otherwise will be removed. This policy is in addition to the provisions of clause 6.2 and 6.4.7.
Unless specifically defined in this Policy, the meanings given to words defined in the User Terms have the same meanings in this Policy. Reference to clause is to the clause in the User Terms.
How Subs moderates content
Clause 8 of the Terms of Service references how Subs moderates the Platform. We use proactive moderation technology and a team of trusted moderators to review User Content in real-time. Our moderation technology scans all images, videos, and text for content that is in breach of our Acceptable Use Policy and content that is prohibited from Subs under clause 7 of the Terms of Service. User Content that is flagged by our technology is suspended from Subs until it is reviewed by the moderation team. If the content is illegal, our moderation team may take steps it deems necessary to report such content to relevant organisations or law enforcement agencies as detailed in clause 9 of the Terms of Service.
Clause 9 of the User Terms invites Users to report to Subs User Content which causes concern to the User in question.
When Subs removes content
Any content that is illegal or is deemed to breach the Terms of Service or the Acceptable Use Policy will be permanently removed from the platform. Clause 6.4.7. Details User’s rights. Every User recognises that decisions made by Subs when reviewing are final. Sub’s statutory obligations mean that the right offered to Users is a right of review and not a right of appeal. Subs also mandate that Users provide as much information as Subs requests.
Reports to the NCA
In accordance with our duties as the service provider, we have systems in place to provide reports of all detected and unreported CSAM content present on the service to the National Crime Agency (“NCA”).
Sexually Explicit Content in Publicly Facing Areas
Sexually Explicit Content is prohibited in Publicly Facing Areas on Subs in accordance with the Terms of Service and Acceptable Use Policy.
Where we identify Sexually Explicit Content in a Publicly Facing Area, we may:
Sexually Explicit Content does not necessarily need to be removed from Subs solely because it was displayed in a Publicly Facing Area. Where the Content is otherwise permitted under our Terms and Policies, we may instead move or reclassify it to an appropriate non-public, restricted or access-controlled area of the Platform. Content does not need to be unlawful or otherwise prohibited throughout the Platform in order for us to restrict or remove it from a Publicly Facing Area.
Where Content has also been shared or automatically published to a third-party service, our restriction on Publicly Facing Areas applies to the Content displayed on Subs. The copy published on the third-party service remains subject to that service's applicable rules and policies.
Repeated, deliberate or serious violations may result in account restrictions, suspension or termination in accordance with the Terms of Service. Users may challenge a moderation decision in accordance with our Complaints Policy.
