1. This policy is incorporated by reference into the terms of service of www.subs.com (“Terms”). The expressions used in this policy have the meaning as set out in the Terms, unless otherwise defined herein. For more information, please visit our Terms of Service at https://subs.com/terms-of-service.

2. By accessing our Platform, you are consenting to adhere to this policy - please review it thoroughly.

3. This policy governs your utilisation of Subs and all User Content, constituting a fundamental aspect of your arrangement with Subs and the Terms. It delineates the permissible and impermissible activities on Subs.

4. User Content on Subs may contain adult material. Subs prohibit illegal or harmful material from being hosted, published or shared on the Platform. This includes but is not limited to content designated as a priority illegal offence and priority content under the Online Safety Act 2023. Subs is committed to cooperating with law enforcement agencies investigating content involving (i) child sexual exploitation and abuse (“CSEA”), (ii) grooming, and (iii) child sexual abuse material (“CSAM”) including image based CSAM or the sharing of URLs displaying CSAM.

5. If you see any User Content that may be in breach of this policy or the Terms, please this to us at compliance@subs.com. Please include with your report all appropriate evidence, including the date and time of identification. Subs will promptly investigate all reports and take appropriate action. For further information, please refer to our Complaints Policy.

User Prohibited Uses

6. By agreeing to our Terms and Policies, in relation to all User Content, you agree that:

   6.1. You will not the Platform in any way that violates any applicable law, regulation, treaty of any applicable governmental body, orders, judgments, or mandates from courts of competent jurisdiction, which includes but is not limited to:

   6.1.1. laws prohibiting sex trafficking, human trafficking and promotion or facilitation of prostitution;

   6.1.2. Intellectual Property Right laws;

   6.1.3. laws against obscene, lewd, defamatory, or libellous speech; and

   6.1.4. laws protecting confidentiality, personal data, privacy rights, and publicity rights.

   6.2. You will not use the Platform in a manner that may exploit or cause harm to individuals or individuals under 18 years of age.

   6.3. You will not use the Platform for anything other than personal purposes, and you will not sell, rent, transfer, or disseminate your Creator account or your User Content on the Platform to any other individual.

   6.4. You will not use graphical nudity or anything that is in breach of this Acceptable Use Policy in profile avatars and banners.

   6.5. You will not upload, post, display, share or publish User Content that:

   6.5.1. displays, references, or contains:

   1. anything that is deemed, subjectively and/or objectively, to be illegal, harmful, harassing, fraudulent, defamatory, hateful, discriminatory, threatening, abusive, vulgar, indecent, objectionable, menacing, scandalous, inflammatory, blasphemous, racially or ethnically offensive, likely to cause an individual offence, annoyance, anxiety, intimidation, alarm, embarrassment, distress, discomfort, or inconvenience, advocates or facilitates violence or unlawful conduct, or anything that is otherwise deemed inappropriate at Subs’ sole and absolute discretion.

   2. individuals under or depicted as being under 18 years old;

   3. individuals unless their depiction in the User Content complies with the applicable requirements on Collaborative Content under clause 6.6 of the Terms; and/or

   4. AI-generated content or content altered or enhanced by AI of an individual (such as Deepfakes), other than where it clearly and only features the Creator, and where Subscribers are reasonably informed and aware that such User Content was AI-generated, altered or enhanced (such as using “#AI” in the User Content caption).

   6.5.2. depicts, advertises, promotes, endorses, markets, encourages, facilitates, solicits or alludes to (whether real, simulated or implied):

   1. CSEA, CSAM or any sexual activity involving anyone under or depicted as being under 18 years old;

   2. weapons, firearms, drugs, psychoactive substances, parts thereof, or items subject to prohibitions or limitations on sale, of their possession, use, supply or sale;

   3. substances or paraphernalia related to drugs;

   4. self-harm and/or suicide, or the encouragement or assistance of self-harm and/or suicide;

   5. terrorism or terrorism-related offences;

   6. incest;

   7. bestiality or actions involving animal cruelty;

   8. violence, kidnapping, rape, coercion, control, stalking, abuse, harassment, hypnosis, intoxication, sexual violence, torture, sadomasochism, sadomasochistic abuse, extreme bondage, asphyxiation, excessive or extreme fisting, prolapsing, age-play or genital mutilation;

   9. illegal solicitation. escorting or prostitution, human trafficking, sexual exploitation of individuals;

   10. the consumption of, or scatological material involving bodily fluids, blood, urine, waste, vomit or excrement;

   11. non-consensual sharing of intimate images, commonly known as "revenge porn" (this refers to any sexually explicit material featuring individuals without their prior, express, and fully informed consent to its creation, distribution, or sharing);

   12. sexual activity, necrophilia or any degrading behaviour or actions with deceased individuals;

   13. eating disordered behaviour;

   14. the sale or purchase of used articles of clothing;

   15. sweepstake, lottery, or other regulated gaming or sales promotion tactics;

   16. employment advertisements;

   17. unauthorised financial advice or promotions;

   18. cyberflashing or the sending of unsolicited intimate images;

   19. epilepsy trolling or the sending of flashing images with intent to cause harm to individuals; and/or

   20. any other illegal behaviour or offences, or behaviour that may be considered obscene under applicable laws.

   6.5.3. contains unrequested sexual material or unsolicited language that sexually objectifies another User or individual without consent, or contains fabricated or manipulated sexual content involving another User or individual;

   6.5.4. contains, endorses, advertises, or alludes to hate speech or deliberately false materials that cause harm to an individual, which includes but is not limited to User Content that is defaming, vilifying, humiliating, degrading, dehumanising, excluding, attacking, threatening, stereotyping, or inciting hatred, fear, or violence against a group or individual based on race, ethnicity, nationality, immigration status, social class, religion, sex, gender identity or expression, sexual orientation, age, disability, serious illness, veteran status, or any other protected characteristic under applicable laws;

   6.5.5. contains or references personal data, private or confidential information of any individual, including your own (such as phone numbers, geographical locations, names, official documents, email addresses, login credentials of any platform including passwords and security queries, financial data such as bank account and credit card information, biometric data, and medical records) without the express written consent of that person;

   6.5.6. involves public nudity where such User Content was captured or broadcasted from a jurisdiction where public nudity is prohibited;

   6.5.7. involves sexual activity in a public space where it is reasonably foreseeable that members of the public may witness the activities where such User Content was captured or broadcasted

   6.5.8. creates the perception or intends to infer that the User Content originates from, or is sanctioned, licensed, or endorsed by, Subs or any other individual or entity, without consent;

   6.5.11. engages in, refers or encourages third-party commercial endeavours or transactions, such as competitions, giveaways, other promotional activities, product placements, advertisements, or recruitment advertisements, without our explicit prior consent; and/or

   6.5.12. is intended to be used or used to extort money or other benefit from a third party in exchange for removal of the content.

   6.6. You will not use the Platform in a manner that is fraudulent, misleading, deceptive or harmful to other Users or third parties, which includes but is not limited to:

   6.6.1. impersonating another individual or entity (whether actual or fictitious) without consent;

   6.6.2 falsely claiming an affiliation, endorsement or sponsorship with any individual or entity;

   6.6.3. accessing or attempting to access Platform User accounts without permission;

   6.6.4. misrepresenting the source, identity, or content of information transmitted on or through the Platform;

   6.6.5. stalking, bullying, abusing, harassing, threatening, or intimidating others;

   6.6.6. financial services fraud or other related offences under the Financial Services Act 2012, Fraud Act 2006, Proceeds of Crime Act 2002 and Criminal Justice and Licensing (Scotland) Act 2010.

   6.6.7. actions that violate rights of others, including Intellectual Property Rights, personality rights, unfair competition, privacy, and data protection rights

   6.7. You will not use other media or methods, such as GIFs and emojis, to communicate content that violates this Acceptable Use Policy.

   6.8. You will not send unsolicited content that is in breach of our Terms and this Acceptable Use Policy to another User or otherwise engage in non-consensual sexual objectification of another User;

   6.9. You will not engage in antisocial, disruptive, or destructive behaviour, including “bombing,” “flaming,” “spamming,” “flooding,” “trolling,” and “griefing” as those terms are commonly understood and used on the internet, or engage in any other behaviour that is likely to harass, annoy, cause distress or offend other Users.

   6.10. You will not excessively post the same or similar User Content, or share inauthentic, repetitive, misleading, or low-quality User Content on the Platform.

   6.11. You will not artificially or fraudulently increase engagement with your User Content or your account on the Platform through platform manipulation, bots or other fraudulent means.

   6.12. You will not record, capture, scrape, reproduce, distribute, download, modify, create derivative works of, publicly display, publicly perform, republish, store, or transmit any User Content including Subscriber Posts, or attempt to circumvent any technical measures that control access to or protect User Content, except as expressly permitted by a Viewing Licence or mandatory law.

   6.13. You will not circumvent, disable, damage, intentionally misuse, or otherwise interfere with the operations of the Platform, any User’s enjoyment of the Platform, or any security-related features that prevent, limit, or restrict the use or copying of any materials or that enforce limitations on the use of the Platform, by any means, including posting, linking to, uploading, including in your User Content or otherwise disseminating viruses, adware, spyware, malware, logic bombs, Trojan horses, worms, harmful components, corrupted data, or other malicious codes, files, or programs designed to interrupt, destroy, limit, disproportionately overload or monitor the functionality of the Platform, the Platform’s infrastructure, or any computer software, hardware or telecommunications equipment.

   6.14. You will not decompile, disassemble, reverse engineer, or otherwise attempt to discover the source code or coding of the Platform, except and only if that activity is expressly permitted by applicable law despite this limitation.

   6.15. You will not access or use any automated process (such as a robot, spider, scraper, or similar) to access the Platform in violation of our robot exclusion headers or to scrape all or a substantial part of the Platform and User Content (other than in connection with bona fide search engine indexing or as Subs may otherwise expressly permit).

   6.16. You will not commercially exploit or make available the Platform to third parties including any action or attempt to “frame” or “mirror” the Platform.

   6.17. You will not cause, assist, permit, or by omission, allow any person to engage in behaviour that is in breach of this Acceptable Use Policy.

   6.18. You will provide accurate information during account registration, maintain up-to-date information and refrain from unauthorised use of another individual's information or content.

   6.19. You may use the Subs name, logo, or related elements only as expressly permitted in the Terms or with prior written consent.

Additional Prohibited Uses for Creators

7.1. As a Creator, there are additional rules on your use of the Platform. By agreeing to our Terms and Policies, you agree that:

7.1.1. You will not deceive users regarding the nature of any Subscriber Posts or Follower Posts;

7.1.2. You will not attempt to defraud Subs or our Users (e.g., working together with a User or unauthorised third party to receive payments from stolen credit cards).

7.1.3. You will not attempt to fraudulently pass off recorded content as a live stream.

7.1.4. You will not fail to honour any lawful representation made to Subscribers for the access of Subscriber Posts and User Content.

7.1.5. You will not record or broadcast nudity or sexual activity or any content in breach of this Acceptable Use Policy from any public place where members of the public are reasonably likely to see your User Content.

7.1.6. You will not release the personal information of any other User of the Platform or third party without that person’s consent in accordance with clause 6.5.5 of this Acceptable Use Policy.

7.1.7. You will not solicit or accept payments or any other kind of benefit, financial or otherwise, for travel or in-person meetings for the purpose of engaging in sexual or otherwise illegal activity.

7.1.8. You will not harass, disparage, defame, or otherwise interfere with Subs or our Users in breach of this Acceptable Use Policy;

7.1.9. You will not misrepresent or make any false or misleading statements about the Platform or Subs.

7.1.10. You will not abuse the blocking function to deprive a Subscriber of their Viewing Access without legitimate grounds under the Terms or our Policies.

7.10. You must not solicit or cause Subscribers to terminate their access to Subscriber Posts in order to purchase a new subscription or other forms of paid access with you (on the Platform or elsewhere) without providing them with the Subscriber Posts they have already accessed pursuant to a prior Viewing Access. Breach of this Section may result in the suspension and/or termination of your Creator account and the withholding and/or forfeiture of earnings under the Terms.

7.2. Subs permit certain adult content on the Platform, subject at all times to these Terms and the Policies. However, Subs restricts how Sexually Explicit Content is made available on the Platform, this is subject to the restrictions under clauses 6.1A and 6.1B of the Terms. A breach of those clauses will have the same effect as a breach of this Policy.

AI-Assisted Messaging

8. Where you enable AI-Assisted messaging, all uses of such functionalities including but not limited to messages, offers and prompts must comply with this Policy and the Terms. You must not use it to generate or send anything prohibited by this Policy, to impersonate any real person, or to mislead Users as to the AI involvement disclosed on the Platform.

Violation of Acceptable Use Policy

9. Violation of this Acceptable Use Policy may result in temporary or permanent account suspension, termination and the revocation of access to Creator Earnings, or other remedial actions taken at the sole discretion of Subs outlined in the Terms.
