Chargebacks and Payment Disputes
This Chargebacks and Payment Disputes Policy governs how chargebacks and refunds are handled on the Subs platform. It applies to all Users and forms part of the Terms and Conditions. By using the platform, Users agree to abide by this Policy.
Prohibition on Unjustified Requests
Users must not initiate:
Good Faith Requirement
Chargeback or refund requests may only be initiated where you have a legitimate, good-faith basis to dispute a transaction under applicable law and these Terms. Users must cooperate fully with any request from us for information, documentation, or other evidence necessary to investigate or contest a chargeback, including but not limited to:
Proof of content delivery or access;
Screenshots, communications, or transaction logs;
Confirmation of identity and account activity.
Failure to cooperate may result in the dispute being resolved against you and/or enforcement action under these Terms.
Platform’s Rights if Bad Faith is Determined If we determine, in our sole discretion, that a chargeback or refund request was made in bad faith, we may:
Creator Liability for Chargebacks Where a subscriber successfully obtains a refund or chargeback for a payment made to a Creator, we may deduct from the Creator’s available or future earnings an amount equal to the Creator’s share of that refunded or charged-back payment.
Post-Closure Liability You remain fully liable for all chargebacks, payment disputes, related fees, and costs connected to your transactions even after your account is suspended, terminated, or closed. We may recover these amounts from any remaining wallet balance, future earnings on any new account, or through lawful collection methods.
No Waiver of Rights Any decision by us not to exercise our rights immediately in response to a chargeback shall not constitute a waiver of those rights, and we may enforce them at any time thereafter.
Legal Compliance This Policy is governed by the laws of England and Wales, and any disputes arising from chargebacks shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer law provides otherwise.
